Teresa Combs has filed a class and collective action lawsuit against Doyle Land Services, Inc. in the United States District Court for the Southern District of Illinois, East St. Louis Division. The case ID is 3:24-cv-01111-NJR and was filed on April 15, 2024. The suit alleges that Doyle Land Services failed to pay overtime wages and other damages.
Combs worked as a Day Rate Worker for Doyle in Illinois from January 2022 until April 2024. She claims that she and other Day Rate Workers were regularly required to work more than 40 hours per week but were not paid overtime. Instead, they received a flat daily rate regardless of the total number of hours worked in a week.
The plaintiff asserts that this pay scheme violates the Fair Labor Standards Act (FLSA) and the Illinois Minimum Wage Law (IMWL), depriving her and other Day Rate Workers of their rightful overtime when they work more than 40 hours in a week. The court has jurisdiction over this case as it involves a federal question under the FLSA.
Combs seeks to represent all similarly situated employees who were paid under this alleged illegal day rate pay scheme by Doyle during the past three years. She also aims to represent an Illinois Class of employees who experienced similar circumstances.
