More plaintiffs should be dropped from Paraquat MDL over failure to answer questions, special master says

EAST ST. LOUIS - Special master Randi Ellis recommended dismissal of 117 Paraquat exposure suits on March 20 for failure to return necessary questionnaires.

Patrick McAndrew of Pulaski Kehrkehr in Houston represents 105 of the overdue plaintiffs.

He has filed 1,080 paraquat suits and 431 have closed for an attrition rate of 40%.

The list of plaintiffs Ellis sent to Chief U.S. District Judge Nancy Rosenstengel included four clients of Tor Hoerman’s firm in Edwardsville and eight clients of other firms.

Rosenstengel presides over almost 6,000 suits from many states against Paraquat producer Syngenta and former producer Chevron.

Plaintiffs claim the weed killer caused Parkinson’s disease.

Their lawyers filed 7,347 suits from the outset in 2021 through this March 3 and 5,859 remained active on that date for an attrition rate of 20%.

Rosenstengel has set jury trials this October and next April.
