EDWARDSVILLE - The owner of a metal pole barn in Troy claims a painting company failed to properly prepare the surface before applying paint, resulting in damages.
The lawsuit was filed in the Madison County Circuit Court by Denis Dineen against Robert Schneider, who operates under the name Schneider Painting Company.
According to the complaint, Dineen hired Schneider in May 2020 to pain a metal pole barn on his property using PPG paint from PPG Industries Inc., which was allegedly purchased by Dineen at Schneider's instruction. However, Dineen claims that within a year of painting, the paint began to delaminate from the barn's structure, requiring several repainting efforts. The subsequent attempts at painting the structure were unsuccessful as the pain continued to delaminate after each repair.
Dineen claims that the repeated attempts at fixing the problem and multiple coats of paint applied by Schneider caused the metal structure of the pole barn to become damaged, requiring replacement. He further alleges that removing the layers of paint would further damage the integrity of the barn's metal structure.
PPG Industries denied any responsibility, the suit states. It instead attributed the damage to improper surface preparation by Schneider.
Dineen is seeking judgment against Schneider for an amount exceeding $50,000, plus court costs and any other relief the court deems proper.He is represented by attorney Matthew Champlin of HeplerBroom.
