Woman sues over icey slip, fall outside Long John Silvers

EDWARDSVILLE - A customer at a restaurant claims the owner failed to maintain the sidewalk, causing her to slip and fall on ice.

Kay Delong filed suit June 3 in Madison County Circuit Court against LJS Opco Two LLC, doing business as Long John Silvers on North Bluff Road in Collinsville, alleging negligence.

Delong claims she was leaving the restaurant on Nov. 14, 2019, when she slipped and fell on the ice. The company allegedly "owed a duty of care to keep its premises in a reasonably safe condition."

Delong claims LJS failed in that duty of care by not maintaining its premises in a safe condition.

Its employees allegedly failed to entirely remove the ice from the sidewalk after attempting to clear the path, according to the suit.

Delong also claims that the company failed to inspect for residual snow and ice and did not prevent the "unnatural accumulation of moisture that then froze and created the dangerous condition."

As a result of the slip and fall, Delong claims she injured her back and right knee. This subsequently led to her incurring medical and surgical expenses and will do so in the future.

She adds that she experienced pain and became permanently disabled.

Delong, who is seeking more than $50,000 in damages, is represented by Lanny Darr of Darr Law Offices in Alton.
