Client accuses health care company of overcharging for medical records

BELLEVILLE — An East St. Louis woman is suing a health care company, alleging she was overcharged for medical records.

Alice Best, individually and on behalf of all others similarly situated, filed a class action complaint March 4 in St. Clair County Circuit Court against Ciox Health LLC, alleging common law fraud and violation of the Illinois Consumer Fraud Act.

The suit states Best was one of many individuals who were overcharged for records requests pursuant to the HITECH Act, which constitutes deception, fraud, false pretense and false preference. The plaintiff claims she made a request for health records Sept. 24, 2018, and Ciox Health sent an invoice for $33.04. She alleges the appropriate fee was $6.50.

Best seeks trial by jury, compensation in excess of $50,000, costs of suit and all other fit relief. She is represented by attorney Daniel R. Seidman of Seidman Margulis & Fairman LLP in Chicago.
