BENTON — A man is suing Union Pacific after he was allegedly injured while working as a locomotive engineer.
Scott M. Beaston filed a complaint Nov. 16 in U.S. District Court for the Southern District of Illinois against Union Pacific Railroad Co. and Cook Coal Terminal, alleging violation of the Federal Employers' Liability Act.
According to the complaint, on Feb. 25, Beaston was in the scope and course of his employment as a locomotive engineer with the defendants when he was injured while attempting to engage a dual control switch.
Beaston claims he sustained severe and permanent injuries to his muscles, tendons, ligaments, nerves, soft tissues, vertebrae, joints and discs of the spine.
The plaintiff alleges Union Pacific Railroad and Cook Coal Terminal failed to provide a dual control switch that was in proper condition, failed to repair and or maintain the switch and failed to give adequate warning of the danger of its condition.
Beaston seeks trial by jury, damages of more than $75,000, plus court costs and interest. He is represented by attonrey John P. Kujawski of Kujawski Marcus LLC in O’Fallon.
