Clerk alleges Union Pacific caused lymphocytic disease

BELLEVILLE — A clerk is suing Union Pacific Railroad Company for allegedly exposing him to toxic substances. 

Danny Biggs filed a complaint on Oct. 18, in the St. Clair County Circuit Court against Union Pacific Railroad Company, alleging it failed to provide a reasonably safe place to work.

According to the complaint, the plaintiff alleges that during the course of his employment with Union Pacific, he was exposed to toxic substances that caused him to develop chronic lymphocytic leukemia and/or other lymphocytic disease. 

He claims he has suffered great pain, disability, mental anguish, and great expenses to cure his injury. 

The plaintiff holds Union Pacific Railroad Company responsible because the defendant allegedly failed to provide safe and adequate equipment to protect him against exposure to benzene-containing products, diesel fuel and diesel exhaust and failed to warn him of the dangerous effects of being exposed to these chemicals.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount exceeding $50,000, plus costs. He is represented by William P. Gavin of Gavin Law Firm LLC in Belleville.
