Former client alleges divorce attorney breached contract

EDWARDSVILLE — A former client is suing is divorce attorney for allegedly misplacing a contract and failing to represent him in his case. 

James Agee filed a complaint on June 29 in the Madison County Circuit Court against Donald E. Groshong alleging breach of contract.

According to the complaint, the plaintiff alleges that in June 2013, he entered into a contract to retain Groshong as counsel in an acrimonious divorce case for a flat rate of $30,000 through the end of the case. However, Agee claims he requested a copy of the contract through an attorney, but Groshong refused to provide the contract and has either lost it accidentally or misplaced it intentionally. 

As a result, the plaintiff was forced to represent himself and had and pay another attorney to represent him in the divorce case. He claims he suffered damages of approximately $50,000. 

The plaintiff requests a trial by jury and seeks damages between $75,000 and $100,000, plus costs of this action.
