Conductor alleges injuries from years of work with railroad company

BELLEVILLE — A conductor claims he suffered repetitive trauma to his arms, wrists and hands due to years of work with Union Pacific Railroad.

Michael Benjamin filed a complaint April 18 in the St. Clair County Circuit Court against Union Pacific Railroad Co. alleging it failed to provide a reasonably safe place to work.

According to the complaint, the plaintiff alleges that since he started working for the defendant in 2005, he has been exposed to repetitive trauma to his arms, wrists and hands, causing him to develop bilateral cubital tunnel syndrome.

Benjamin claims he has suffered great pain and anguish and extreme nervousness and that he lost wages and incurred medical expenses.

The plaintiff alleges Union Pacific Railroad failed to provide adequate tools or equipment for the job, failed to properly maintain its equipment and failed to warn employees of the ergonomic risk of their job duties.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, plus costs of this action.

He is represented by William P. Gavin of Gavin Law Firm LLC in Belleville.
