Daughter files suit against Akebono Brake Corp., others over father's cancer death

BELLEVILLE – An estate representative alleges her father's exposure to asbestos caused him to develop lung cancer.

May Evelyn Wimbush, individually and as special representative of the estate of Evans Trammel, deceased filed a complaint on Nov. 30 in the St. Clair County Circuit Court against Akebono Brake Corp., Cooper Industries, General Electric Co., et al. alleging negligence.

According to the complaint, the plaintiff alleges that at various times during Trammel's life, he was exposed to, inhaled or ingested large amounts of asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. The suit states that on or about July 14, 2016, he first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. The suit states he died Sept. 9, 2017.

The plaintiff holds Akebono Brake Corp., Cooper Industries, General Electric Co., and others responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew or should have known that it was toxic and poisonous and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory damages of more than $50,000. She is represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
