Union Pacific demands jury trial in man’s lung cancer suit

Union Pacific Railroad Co. has demanded a jury trial on all triable issues in a case over a former employee’s claim that his exposure to carcinogens led to lung cancer.

Edmund Borgman filed the lawsuit on July 19, claiming he developed cancer as a result of his exposure to various toxic substances, including asbestos, second-hand cigarette smoke and, diesel exhaust, during his career.

He worked in the clerical department at Union Pacific from 1959 until 1968,according to the suit.

Borgman accuses his former employer of failing to provide him with a safe place to work, exposing him to various toxic substances, failing to warn him of the dangers of the substances and allowing unsafe work practices to become common.

His suit seeks a judgment of more than $50,000.

Belleville attorney William P. Gavin represents Borgman.
