Castrol seeks dismissal from suit

Castrol Industries is asking Circuit Judge Daniel Stack to be dismissed from a suit filed by an employee of Owens Brockway Glass Container in Godfrey who claims he was sickened from exposure to Syntilo 9918 and other “metal working fluids.”

Represented by Ted Gianaris from SimmonsCooper of East Alton, Mike DeSherlia filed his complaint April 4 in Madison County Circuit Court seeking damages in excess of $200,000

“Plaintiff developed severe and chronic respiratory difficulties (including) shortness of breath, chronic and persistent cough, inability to breathe normally, asthma, skin lesions, nasal passage irritation and lesions, anxiety and depression,” according to the complaint.

DeSherlia allegedly developed a benign lung tumor from his exposure, according to the suit.

The suit alleges negligence, strict liability, willful and wanton misconduct and breach of warranty.

Stack will hear the motion at 9 a.m. on Aug 24 in Courtroom 311.
