Wal-Mart seeks to dismiss Peach class action
Ashley Peach, who has three pending class actions suits in Madison County, will be in court March 14 for her case against Wal-Mart, on its motion to dismiss the suit.

Luther Trammell filed an asbestos lawsuit in St. Clair County Feb. 24 claiming 50 defendants who manufactured asbestos products caused his asbestos-related illness.
R.P. Lumber sued by concrete form setter
Billy J. Morber filed a lawsuit seeking at least $50,000 in damages against R.P Lumber in St. Clair County Circuit Court Feb. 25.
Illinois Power settles for $500 million in 'Clean Air' case
Illinois Power Co. will install $500 million in pollution controls at five coal-fired power plants and pay a $9 million fine to settle a federal lawsuit alleging Clean Air Act violations.

Parents sue towing company for children's injuries
A Fairview Heights mother and father are seeking more than $1 million in damages from Lincoln Trail Auto Body and its employee, Roland Lee Seibert, for injuries their five children sustained when they were involved in an auto accident the day after Christmas.
St. Elizabeth's and Cahokia nursing home sued
St. Elizabeth’s Hospital and Cahokia Nursing and Rehabilitation Center were named in a negligence and wrongful death lawsuit filed in St. Clair County Feb. 18 by Lillie Smith. She claims Chauncey Smith, who died Feb. 19, 2003, received poor treatment which ultimately led to his death.

Defendant Gerards Design Studio requested discovery on defendant Rusk who objected. Judge Byron overruled the objection and ordered Rusk to comply by Mar. 8. All other pending motions were reset for Mar. 11.
Belleville Memorial named in Madison County wrongful death suit
Ryan Winschief filed a 10-count, $500,000 wrongful death suit against Belleville Memorial Hospital and several local cardiologists blaming them for his father’s death.

Doctor sued over gall bladder operation
Leigh Ann Monk of St. Louis filed a medical malpractice suit against Thomas Vitale, M.D. in St. Clair County Circuit Court alleging he attempted to remove her gall bladder while it was still connected to the bile duct.

AT&T prevailed in an appeal to the 5th Appellate Court regarding a class action consumer fraud case filed by Sandra K. Ragan and Dennis Mangiaracino in 2002 in Madison County Circuit Court.
