Suit alleges motorist caused fatal crash, fled the scene

EDWARDSVILLE - A motorist is being sued for allegedly causing a fatal crash on E. Roodhouse Road and then fleeing the scene.

The lawsuit was filed in the Madison County Circuit Court against David A. Clark, Phillip Kirchner, and Brandi D. Orr for their alleged involvement in a fatal car accident. The plaintiff, Terry Menge, is acting as the Special Representative and Special Administrator of the Estate of Judy Ann Menge, who was killed in the crash.

According to the complaint, on Nov. 9, at approximately 6:47 p.m., Judy Ann Menge was operating a vehicle on E. Roodhouse Road near NE 925 Avenue intersection when she was struck by a vehicle operated by Clark. The complaint alleges Clark was negligent and willfully disregarded his duty to operate his vehicle safely. It also alleges Clark was under the influence while operating the vehicle.

The lawsuit also states that Kirchner was negligent in his operation of a vehicle, which resulted in injuries to Judy Ann Menge. 

The plaintiff seeks damages in excess of $50,000 from each defendant for costs incurred and further relief deemed just and proper by the court. The plaintiff is represented by The Caffey Law Firm, LLC.
