BELLEVILLE - An Illinois man filed a class action lawsuit against Carrollton Bank over its $25 charge for overdrafts.
"Defendant misleadingly and deceptively misrepresents its fee assessment practices, including in its own account contacts," the suit filed in St. Clair County Circuit Court states.
According to the complaint, on Oct. 9, 2019, defendant Carrollton Bank charged plaintiff James Thompson a $25 overdraft fee on a purchase even though the balance in his account was positive by more than $750 after the transaction cleared. He alleges the defendant's own account statements proves that he had sufficient funds.
Thompson claims the bank "abuses the power it has over customers and their accounts and acts contrary to their reasonable expectations under the contract. This is a breach of defendant's implied covenant to engage in fair dealing and to act in good faith."
The lawsuit states that bank has more than $3 billion in assets, with branches in Illinois and Missouri, including St. Clair County.
Thompson seeks restitution of all improper fees paid, actual damages, pre- and post-judgment interest, court costs and attorney fees. He is represented by David Cates of Cates Mahoney LLC in Swansea.
