Cedarhurst Nursing Home accused of negligence leading to resident's death

BELLEVILLE – Cedarhurst Nursing Home has been named in a wrongful death lawsuit alleging that negligence lead to the death of a resident.

Plaintiff William J. Ellis, acting as executor of the estate of Rosemary Ellis, filed a lawsuit in the St. Clair County Circuit Court against defendant Cedarhurst of Shiloh HTI Management, LLC, citing negligence and carelessness.

According to the lawsuit filed May 11, Rosemary was a resident of Cedarhurst which allegedly knew that she was susceptible to falling down. The plaintiff alleges that on Nov. 10, 2021, Rosemary fell, causing her to sustain a closed head injury which lead to her eventual death. 

The plaintiff claims that Cedarhurst did not provide Rosemary proper care and supervision to protect her from injuring herself. The lawsuit further states that the defendant's negligence lead to Rosemary's death and has caused her surviving family undue grief and sorrow.

The plaintiff is seeking damages in excess of $50,000, plus any other relief the court deems proper. He is represented in this case by attorney John Hiskind of Hipskind & McAninch, LLC in Belleville,
