Tenant alleges injuries from collapsed ceiling at Belleville apartment

BELLEVILLE — A tenant claims a portion of her bedroom ceiling collapsed at a Belleville apartment complex, causing her to suffer injuries. 

Samara Sanders filed a complaint in the St. Clair County Circuit Court against Bouse Fiudo, alleging negligence. 

According to the complaint, Sanders was a tenant at the defendant's property on West Boulevard in Belleville. She claims that in October 2021, she noticed the ceiling in her bedroom began to bow as it rained outside. 

She claims she notified the defendant of the dangerous condition, who began repairs on the ceiling a few weeks later. Sanders alleges that on Nov. 10, 2021, the defendant placed a 2 x 4 board between the floor and the ceiling to prevent it from collapsing. She claims that the next day, the board kicked out toward her, striking her in the leg and causing the ceiling to collapse on her. As a result, she claims she suffered injuries to her neck and back. 

Sanders alleges the defendant was negligent for failing to properly maintain the ceiling, failing to inspect the ceiling and for not having a safe procedure for repairing the ceiling. She also alleges the defendant failed to provide her with a safe and proper place to live and for failing to warn her of the hazard and risk. 

Sanders claims she also suffered lost wages and incurred medical treatment costs. 

Sanders seeks compensation of more than $50,000 and all other just relief. She is represented by John Hipskind and Brady McAninch of Hipskind & McAninch LLC in Belleville.
