Man files Dram Shop suit against Miss Kitty's after mother dies in DUI crash

BELLEVILLE — A man filed a Dram Shop suit against Miss Kitty's after his mother suffered fatal injuries in a head-on collision with an intoxicated driver. 

Aubrey Spencer filed a complaint in the St. Clair County Circuit Court against Miss Kitty's Inc., alleging violation of the state's Dram Shop law. Aubrey Spencer filed the complaint following the death of his mother, Audrey Spencer, 66. 

Spencer alleges in his complaint, that his mother was driving her vehicle on Interstate 44 near the Walnut exit on April 9, 2021. The suit states that Curtis Lee was driving his Ford Transit on Interstate 44 while intoxicated and struck Audrey's Spencer's vehicle head-on and caused her to suffer fatal injuries. 

The plaintiff claims that prior to the accident, Lee patronized Miss Kitty's saloon and had become visibly intoxicated. Specifically, he claims Lee was so intoxicated that he exhibited impairment in his speech, conduct and gait which was documented by his blood alcohol level. 

Aubrey Spencer alleges that Lee's intoxication was or should have been plainly visible to a reasonable person, but Miss Kitty's employees continued to serve him alcoholic beverages. He also alleges Miss Kitty's failed to act with reasonable care towards the general public and that its employees breached that duty, according to Missouri's Dram Shop law.  

Spencer seeks monetary relief of more than $50,000, plus interest, trial by jury and all other just relief. He is represented by Amanda Murphy of Goldblatt + Singer in Clayton, Mo.
