Christian County woman sues Abert Trucking following rear end collision in Vandalia

EDWARDSVILLE – A Christian County resident is suing Abert Trucking after one of its employees allegedly caused a rear end collision in Vandalia.

Plaintiff Whitney A. Voyles filed the lawsuit on March 23 in the Madison County Circuit Court against Russell, Abert & Sons, doing business as Abert Trucking, and Mark A. Abert, citing negligence and carelessness by employee Aaron R. Stucker.

According to the lawsuit, on Oct. 28, 2020, Voyles was driving on Route 51 near where it intersects with East 1900 Ave. in Vandalia. She claims she slowed down because a vehicle in front of her was making a turn when a semi-truck that was being operated by Stucker allegedly struck her from behind.

The lawsuit claims that Stucker was following Voyles' vehicle more closely than was reasonable and that Stucker was driving at a speed that was greater than reasonable. Voyles claims she has suffered permanent and progressive injuries to her neck, back, and head and has sustained "great pain and mental anguish." 

Voyles states that she has incurred medical expenses as a result of the collision and will continue to require the services of medical staff to recover. 

Voyles is seeking damages in excess of $50,000, plus court costs. She is represented in this case by attorneys Rachel L. Roman, Anna E. Haber, Morgan C. Murphy and David M. Zevan of Zevan, Davidson, Roman, LLC in St. Louis.
