Delivery driver allegedly injured while using faulty ladder

Lawsuits

BELLEVILLE — A trucking company is suing a chemical supplier on behalf of one of the plaintiff's drivers who was allegedly injured during a delivery.

Twin Lake Trucking LTD, on behalf of employee Maehugh George, filed a complaint  July 8 in the St. Clair County Circuit Court against Brenntag Inc., Brenntag Midsouth Inc., and Petra Industries Inc., alleging negligence and premises liability.

According to the complaint, George was working for Twin Lake on July 11, 2018, when he was delivering a shipment to Brenntag's premises in East St. Louis.  Per federal law, George was required to change the "hazardous placards" for his loads which indicated the container had hazardous material, the suit states. He alleges that while using the extension ladder he was given by a Brenntag employee to change his hazardous material placards, the ladder slid and caused him to fall.

George claims that "on every other occasion," the Twin Lake driver picking up the containers was supplied with a stepladder to remove the placard and that the normal Petra and Brenntage worker who gave the drivers the stepladder was not there during George's delivery.

He claims the defendants were negligent for not providing him a safe means for removing the hazardous material placards and provided him with the wrong type of ladder, the suit states.

George seeks monetary relief of more than $50,000, plus all other proper relief. He is represented by James Kelly of The James Kelly Law Firm.
