BELLEVILLE — A woman who was picking fruit at a Belleville orchard claims she suffered injuries from slipping on peaches that had not been cleaned up off the ground.
Alyssa Diehl filed a complaint July 15 in St. Clair Circuit Court against Eckert's Inc., alleging negligence.
According to the complaint, Diehl claims that on Aug. 26, 2018, she was at Eckert's orchard in Belleville where she was picking fruit. She claims she suddenly slipped and fell on peaches that had been left on the ground at the orchard.
Diehl claims she suffered "severe, painful, permanent and progressive bodily injuries" as a result of her fall, including an injury to her ankle.
She alleges Eckert's was negligent in failing to have a "safe and proper path" for patrons at the orchard. She also alleges Eckert failed to inspect the premises and failed to properly clean up the fruit, which created an unreasonably dangerous condition and caused a slipping hazard.
Diehl states in her suit that the orchard allowed the dangerous condition to exist.
The plaintiff alleges the fall has also caused her to undergo medical, hospital, surgery and therapeutic treatment and incur expenses.
Diehl seeks monetary relief and all other proper relief. She is represented by Thomas Fagan of The Hullverson Law Firm in St. Louis.
