Woman sues Wendy's over trip, fall at Belleville restaurant

BELLEVILLE —A woman is suing a Belleville Wendy’s, alleging she was injured when she tripped and fell while walking in the parking lot. 

Mamie Saffore filed a complaint on June 7 in St. Clair County Circuit Court against BB St. Louis LLC, Wendy’s Properties LLC and Wendy’s International LLC alleging negligence.

The suit states that Saffore was walking through the parking lot at the Wendy's restaurant located at 2600 Green Mount Commons Dr. in Belleville when she allegedly tripped and fell over a hole. Saffore claims the defendants were responsible for maintaining the cleanliness and safety of the premises, including the parking lot. However, she claims the defendants failed to meet that duty, causing the alleged incident. 

Saffore alleges the condition of the parking lot was unnecessarily dangerous and posed an unreasonable risk to Wendy's customers, including the plaintiff. 

The plaintiff alleges that the defendants were negligent by carelessly failing to maintain the parking lot, failing to block or rope off the hazardous condition and failing to place cones, signs or other warnings to the invitees, including the plaintiff, which may have prevented such an incident from occurring.

As a result of the fall, the plaintiff claims she has been caused to suffer serious and significant physical injuries to her right hand, knee, hip and ring finger, all of which have required medical diagnosis and care. The plaintiff’s life has been irreparably harmed by the injuries suffered due to the negligence of the defendant, the suit states.

Saffore is seeking trial by jury, relief in excess of $50,000, costs incurred and other relief deemed fit. The plaintiff is represented by Todd R. Nissenholtz of Cofman Townsley LLP in St. Louis.
