BELLEVILLE — The administrators of a man's estate are suing Bi-state Development after one of the defendant's bus drivers allegedly hit and killed a pedestrian.

Tasha Nicholson, Kenya Jackson and Charles Franklin II, as co-administrators of the estate of Sherman Nicholson, deceased, filed a complaint on May 7 in St. Clair County Circuit Court against John McGee, The Bi-State Development Agency of the Missouri-Illinois Metropolitan District doing business as Bi-State Development Company, doing business as Bi-State Development, alleging wrongful death and negligence.

According to the complaint, Sherman Nicholson was a pedestrian at the intersection of 69th St. and St. Clair Ave. on Jan. 4 at approximately 1:34 a.m. At the same time, McGee was allegedly operating a metro bus when he allegedly failed to stop or yield to the decedent and struck him. As a result, Sherman Nicholson suffered head trauma which allegedly led to his death on Jan. 8.

The plaintiffs allege McGee carelessly operated the vehicle without due regard for the safety of others, operated the bus at an excessive speed, failed to keep the bus under proper control, and failed to keep a proper lookout.

The plaintiffs are seeking relief in excess of $50,000, plus costs of the suit and other relief deemed fit. The plaintiffs are represented by Troy E. Walton and Adam W. Bragee of Walton Telken LLC in Edwardsville, Pam Brennan of the Law Offices of Pamela A. Brennan LLC in Belleville and Lindsey Goetz of Dixie Law Group in Louisville, Ky.
