Suit alleges client refuses to pay after ignoring installation warnings

EDWARDSVILLE —An industrial service company is suing a client who ignored warnings about winter installations and refuses to pay due to the resulting damages. 

Christy Industrial Services LLC filed a complaint on April 22 in the Madison County Circuit Court against GRP Mechanical Company Inc., City Water, Light & Power, Mike Gorsek, alleging breach of contract.

The suit states that Christy Industrial Services entered into an agreement with the defendants on Oct. 26, 2017. According to the agreement, the plaintiff provided installation services for the defendants, which would be completed by Dec. 4, 2017. The plaintiff alleges the defendants delayed the performance time by pushing the timeline into the winter. 

Christy Industrial Services alleges it warned the defendant that they should not install refractory material in cold temperatures, but the defendants allegedly ignored the warnings. When the refractory suffered from the winter installation, the defendants failed to take responsibility for the damages, the suit states. The plaintiff alleges the defendants have refused to pay for the work performed. 

The plaintiff is seeking a trial by jury, relief in the amounts of $245,000, $140,000, $15,000, plus attorneys' fees, court costs and other relief deemed fit.. The plaintiff is represented by James Patrick Bick Jr., of Bick & Kistner PC in Clayton, Mo., and Michael D. Quinlan of Quinlan Law Firm LLC in St. Louis.
