Hospital visitor alleges elevator malfunctioned, fell 6 floors

BELLEVILLE — A visitor is suing a Belleville hospital and an elevator company, alleging he was injured when an elevator malfunctioned and fell six floors.

Cody Toon filed a complaint Feb. 27 in St. Clair County Circuit Court against Otis Elevator Company and St. Elizabeth's Hospital of the Hospital Sisters of the Third Order of St. Francis, alleging negligence.

The suit states Toon was at St. Elizabeth's Hospital located on Third St. in Belleville on March 8, 2017 when he was a passenger in an Otis-built elevator owned and controlled by the hospital. Toon claims the elevator fell six floors, throwing the plaintiff violently and resulting in physical and emotional distress, plus medical expenses.

The suit states the defendants failed to inspect the elevator.

Toon seeks compensation in excess of $50,000 plus all fit relief. The plaintiff is represented by attorney Jason R. Caraway of Caraway, Fisher & Broombaugh in Belleville.
