Motorist alleges insurer failed to approve claim over Alton crash

EDWARDSVILLE — A motorist is suing his insurer for allegedly failing to approve his claim after a motorist ran a stop sign and caused a collision in Alton. 

James Vaughn filed a complaint on Jan. 4 in the Madison County Circuit Court against The Allstate Fire and Casualty Insurance Company, alleging breach of contract. 

According to the complaint, the plaintiff alleges that on Oct. 13, 2017, he was driving a vehicle traveling on Madison Avenue at its intersection with Gresche Street in Alton when Reginald Washington, an uninsured driver, ran a stop sign and struck the vehicle he was operating. 

Vaughn claims he sustained damages and made a written policy demand to the defendant, without success. 

The plaintiff alleges Allstate Fire and Casualty Insurance failed to deny his claim or to make an offer without reasonable excuse. 

The plaintiff requests a trial by jury and seeks damages of more than $50,000, plus penalties. He is represented by Keith Short and Jack Daugherty of Short and Daugherty PC in Alton.
