Employee benefit fund administrators allege East St. Louis company failed to make contributions

BENTON — An engineers union's employee benefit plan administrators are suing an East St. Louis business, alleging breach of fiduciary duty.

International Union of Operating Engineers Local 520, et al, filed a complaint Nov. 19 in U.S. District Court for the Southern District of Illinois against Zoie LLC, alleging violation of of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege Zoie failed to submit its reports and contributions when due, causing the plaintiffs' employee welfare benefit funds to be damaged. 

The plaintiffs seek a trial by jury, judgment for the amounts found due and owing, plus liquidated damages, interest, attorney fees and court costs and any further just and proper relief. They are represented by attorney Greg A. Campbell of Hammond & Shinners in St. Louis.
