Nurse practitioner accuses medical group of unpaid wages

BENTON — A nurse practitioner is suing her former employers, alleging they failed to pay her proper wages and overtime pay. 

Jami Mayhew, individually and as sole owner of Primary Healthcare Solutions Inc., filed a complaint Dec. 14 in U.S. District Court for the Southern District of Illinois against General Internal Medicine and Dr. Thomas M. Prose, alleging violation of the Illinois Minimum Wage Law and the Illinois Whistleblower Act.

According to the complaint, between 2014 and 2018, Meyhew claims she provided ear cleaning services to the defendants' patients without receiving the minimum wage and full overtime compensation. Mayhew alleges she was forced to resign Dec. 11 due to threats of legal action. 

The plaintiff alleges General Internal Medicine and Prose intentionally failed to pay any wages for the time she spent working on-call and failed to pay one and one-half times her regular wage for time worked in excess of 40 hours per week, as required by state and federal law. She also alleges the defendants constructively terminated her for engaging in a protected activity.

Mayhew seeks trial by jury, all unpaid wages, plus liquidated damages, attorney fees, witness fees, court costs and all other just relief. She is represented by attorney Jeffrey T. Bash of Lewis Brisbois Bisgaard & Smith LLP in Edwardsville.
