Worker accuses freight car systems provider of wrongful termination

EDWARDSVILLE — A Madison man is suing a freight car company, alleging retaliation and wrongful termination.

Don L. Garrett filed a complaint Dec. 19 in Madison County Circuit Court against Amsted Rail Company Inc., alleging the defendant willfully and wantonly disregarded the plaintiff's rights.

According to the complaint, on March 2, Garrett was terminated from his employment. The suit says Garrett has suffered and will continue to suffer loss of income and fringe benefits, loss of employment, inconvenience, humiliation and mental anguish. 

The plaintiff alleges Amsted Rail terminated his employment in retaliation for Garrett exercising his rights under the Illinois Workers' Compensation Act.

Garrett seeks trial by jury, judgment of more than $50,000, plus court costs and punitive damages. He is represented by attorney Edward J. Szewczyk of Callis, Papa & Szewczyk PC in Granite City.
