Truck driver alleges cargo van driver caused Shiloh crash

BELLEVILLE — A motorist is suing the driver of a cargo van for allegedly causing a rear-end collision in Shiloh. 

Kendra Leisgang-Prestito filed a complaint Dec. 5 in St. Clair County Circuit Court against Carolyn McDaniel, Smoke Services Restoration Inc., et al, alleging McDaniel failed to exercise due care and caution in operating the cargo van owned by Smoke Services.

According to the complaint, on Dec. 7, 2016, Leisgang-Prestito's Chevrolet truck was stopped on North Greenmount Road, north of Washington Drive in Shiloh. The plaintiff claims her truck was struck from the rear by the defendants' cargo van, which was driven by McDaniel. 

The suit states that Leisgang-Prestito suffered serious and permanent injuries to her head, back, neck and shoulders. 

The plaintiff alleges McDaniel failed to free herself from electronic distractions, failed to keep a safe distance and failed to operate the cargo van at a reasonable speed.

Leisgang-Prestito seeks trial by jury, judgment exceeding $50,000, plus court costs and all other just relief. She is represented by attorneys Michael T. Blotevogel, Roy C. Dripps and Charles W. Armbruster III of Armbruster, Dripps, Winterscheidt & Blotevogel LLC in Maryville.
