Passenger alleges injuries from Shiloh collision

BELLEVILLE — A passenger claims he was injured when the driver of a cargo van caused a rear-end collision. 

Michael Prestito filed a complaint on Dec. 6 in the St. Clair County Circuit Court against Carolyn McDaniel, Smoke Services Restoration Inc., et. al., alleging McDaniel failed to exercise due care and caution.

According to the complaint, the plaintiff alleges that on Dec. 7, 2016, he was riding in a Chevrolet truck on North Greenmount Road in Shiloh when McDaniel, who was driving a cargo van owned by Smoke Services, caused a rear-end collision. 

Prestito claims he sustained serious injuries resulting in pain and suffering, disfigurement and loss of a normal life. 

The plaintiff alleges McDaniel failed to free herself from electronic distraction, failed to keep a safe distance and failed to operate the cargo van at a reasonable speed.

The plaintiff requests a trial by jury and seeks judgment against the defendants for a sum exceeding $50,000, plus costs and all other relief deemed just and appropriate. He is represented by Justin B. Mattea and Morgan J. Hermanson of Justin B. Mattea Attorney at Law in Maryville.
