EDWARDSVILLE — A surviving spouse is suing a car wax manufacturer for allegedly failing to provide warnings of the risks associated with using the car polish.
Marilyn Alford, individually and as independent administrator of the estate of Rodney Alford, deceased, filed a complaint on Oct. 24 in the Madison County Circuit Court against Turtle Wax Inc., alleging that the car wax manufacturer failed to exercise reasonable care and caution for the safety of those using their car polishers.
According to the complaint, the plaintiff alleges that during Rodney Alford's life, he regularly used Turtle Wax car polish on his automobiles, exposing him to benzene through inhalation and dermal contact. As a result, he was diagnosed with acute myeloid leukemia in 2000 and died from it in 2016, the suit states.
The plaintiff holds Turtle Wax responsible because the defendant allegedly negligently included benzene in its products when substitutes were available and failed to provide adequate warning that benzene-containing products had toxic, poisonous and highly deleterious effect to person's health.
The plaintiff requests a trial by jury and seeks compensatory damages of more than $50,000, plus costs and all other relief that is appropriate. She is represented by Christopher W.
