Suit alleges breach of contract in school district insurance dispute

EDWARDSVILLE — A partner accuses a financial company of breach of contract for allegedly attempting to exclude him from an insurance deal with the Bethalto school district. 

David Wiegand filed a complaint on Oct. 18 in the Madison County Circuit Court against Kerry L. Baugher and Baugher Financial & Associates Inc., alleging they breached the implied covenant of good faith and fair dealing.

According to the complaint, the plaintiff alleges that since 2013 the parties have been engaged in a joint venture providing insurance brokerage services to Bethalto Community Unit School District #8. Wiegand alleges the defendants attempted to exclude him from participating in the account and denied his share of his commissions and bonuses. 

As a result, the plaintiff claims he has been damaged for not receiving all the commissions and bonuses to which he is entitled. 

The plaintiff requests a trial by jury and seeks damages in excess of $50,000, plus attorney's fees, costs, interest and all other relief the court deems proper and just. He is represented by Mark C. Goldenberg and Thomas C. Horscroft of Goldenberg Heller & Antognoli PC in Edwardsville.
