BELLEVILLE — An insurer is suing a driver after it had to pay underinsured motorist benefits following a collision.
Progressive Advanced Insurance Co., a/s/o Rhonda Johnston, filed a complaint on Oct. 17 in the St. Clair County Circuit Court against Frankie W. Hook, alleging he breached his duty to exercise ordinary care to avoid the collision.
According to the complaint, the plaintiffs allege that on Nov. 9, 2015, Progressive Advanced Insurance was required to pay Johnston the sum of $50,150.85 for damages she suffered in a collision allegedly caused by Hook near the intersection of Vandeventer Avenue and Martin Luther King Boulevard. Johnston had an underinsured/uninsured motorist provision in her insurance policy.
Progressive Advanced holds Hook responsible because the defendant allegedly failed to yield right of way, failed to drive his vehicle within the safe and reasonable speed and failed to keep proper lookout.
The plaintiffs request a trial by jury and seek judgment against defendant in a fair and reasonable amount of $50,150.85, plus costs. They are represented by Claire M. Connolly of Deutschman & Associates PC in Chicago.
