Kryen Louis, a minor, by his mother and next friend, Lamyra Louis, and Lamyra Louis filed a complaint on Oct. 10 in the Madison County Circuit Court against Darrell Smith, alleging he breached his duty to exercise ordinary care in operating his vehicle.

According to the complaint, the plaintiffs allege they were in a vehicle traveling in a parking lot located at 1837 Adams Parkway in Alton when the defendant allegedly caused his pickup truck to collide with the plaintiffs' vehicle.

The plaintiffs claim they suffered extensive injuries to their bodies which resulted in pain and suffering, medical expenses and other damages that are pecuniary in nature.

The plaintiffs hold Smith responsible because the defendant allegedly drove his vehicle at a speed greater than was reasonable, failed to keep proper lookout and failed properly apply brakes to stop his vehicle and avoid the collision.

The plaintiffs request a trial by jury and seek a judgment against the defendant in an amount exceeding $50,000, plus costs and all other relief deemed just. They are represented by Rodney D. Godfrey of The Caffey Law Firm LLC in Godfrey.
