Truck driver, employer sued following fatal crash

BELLEVILLE — A tractor-trailer driver was allegedly using an electronic communication device when he caused a fatal crash in Marion last year. 

Joshua Maxwell, as administrator of the estate of Wayne S. Maxwell, filed a complaint on Oct. 3 in St. Clair County Circuit Court against Venture Express Inc. and Willie Lee Shelby. 

According to the complaint, Venture Express employee Shelby was driving a tractor-trailer northbound on Interstate 57 when he crashed into Wayne Maxwell's delivery van, who suffered fatal injuries.

The plaintiff alleges Shelby was using an electronic communication device while driving and failed to avoid the accident.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of $50,000, plus costs. He is represented by Anthony P. Gilbreth of Crowder & Scoggins Ltd. in Columbia.
