Property owner alleges insurer denied fire claim

BELLEVILLE — A property owner is suing State Farm and Casualty Company for allegedly denying her claim following a fire. 

Heather Brinkley filed a complaint on Sept. 27 in the St. Clair County Circuit Court against State Farm and Casualty Company, alleging the liability insurer violated the Illinois Insurance Code.

According to the complaint, the plaintiff alleges that on Feb. 9, 2017, her insured property located at 14146 Timberline Drive in DeSoto was damaged by fire. Subsequently, she made a claim for her losses for all sums to which she was legally entitled. 

The plaintiff holds State Farm and Casualty Company responsible because the defendant allegedly failed to provide coverage for the plaintiff's damages because she allegedly made false statement to conceal material facts in her presentation of claim.

The plaintiff requests a trial by jury and seeks damages in an amount in excess of $50,000, plus costs and all further just and proper relief. She is represented by Jeremy A. Gogel of The Gogel Law Firm in St. Louis.
