Live-in health aide accuses man of battery, and wrongful eviction

EDWARDSVILLE — An accused murderer faces civil action over battering his home health aide.

Michelle L. Dublar filed a complaint on Aug. 28 in Madison County Circuit Court against Brian K. France alleging battery and negligence.

According to the complaint, France grabbed or pushed Dublar on three occasions during her time providing home health care to him. Dublar claims France injured her during these times and she sustained permanent injuries to her shoulder, left knee and leg. 

France is currently in jail on murder charges, the complaint states. 

Dublar, who paid France $400 to live in his home and provide home health care, also claims he wrongfully evicted her, according to the complaint. 

Dublar requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000. She is represented by Brian M. Wendler, Angie Zinzilieta, ad Paul Rademacher of Wendler Law PC in Edwardsville.
