Pedestrian sues driver for alleged negligence

BELLEVILLE — A pedestrian is suing a motorist for allegedly hitting her while walking along Warrensburg Drive. 

Carole J. Eckert filed a complaint on July 30 in the St. Clair County Circuit Court against Rose T. McKinney, alleging she breached her duty to exercise reasonable care in operating her vehicle.

According to the complaint, the plaintiff alleges that on Aug. 22, 2016, she was walking on Warrensburg Drive in Stokey Township when she was struck by the defendant's vehicle. 

Eckert claims she suffered injuries resulting in medical expenses, loss of income, pain and loss of normal life. 

The plaintiff alleges McKinney failed to keep proper lookout, failed to yield to a pedestrian and drove her vehicle at an excessive speed.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs of this suit. She is represented by Jon E. Rosenstengel of Bonifield & Rosenstengel PC in Belleville.
