EDWARDSVILLE — A tractor-trailer driver claims he was injured when a tow truck driver began operating the lift while the plaintiff was still gathering his belongings.
Larry Allen filed the complaint on July 10 in Madison County Circuit Court, alleging the tow truck company did not properly train its employees.
Carolina Casualty Insurance Company and Berkleynet Underwriters, as assignees of Larry Allen and J&L Services Inc. filed a similar but separate complaint against McLanahan Towing.
According to the complaints, Allen's truck broke down on July 10, 2016, and he called a tow truck driver from McLanahan Towing. After the tow truck driver arrived on scene, Allen claims he was retrieving items from his truck when the tow truck driver began operating the truck lift. Allen alleges he fell and severely injured his leg.
As a result of the injury, Allen's employer, J&L Services, claims it must make workers' compensation payments to Allen. The plaintiffs claim McLanahan Towing is responsible for its employee's negligence.
The plaintiffs in each case request a trial by jury and seek damages, costs and attorney fees.
