Couple seeks refund of pool price from Atlantis Pools over alleged defects

EDWARDSVILLE – The owners of an Alton property allege a pool they had installed now has construction problems and are seeking a refund.

Rodney Overstreet and Colleen Overstreet filed a complaint on June 29 in the Madison County Circuit Court against Atlantis Pools Inc. alleging that the swimming pool company failed to perform work in a skillful and workmanlike manner.

According to the complaint, the plaintiffs allege that in 2016, the defendant installed an in-ground swimming pool and concrete pool deck.

The plaintiffs hold Atlantis Pools responsible because the defendant allegedly used cheap imitation products and deficient grouting, which has put the pool in a dangerous condition. They allege repairs are not economically feasible and that the defendant has refused to take any action to meet its contractual obligations concerning construction quality.

The plaintiffs seek judgment against the defendant of more than $50,000, attorney fees and costs and all other relief that are just and equitable.
