Damages sought from owners of O'Fallon property over deck collapse

BELLEVILLE – Two individuals are suing the owners of an O'Fallon property after the deck they were standing on collapsed.

Shamisa M. Hughes and Robert F. Hughes filed a complaint June 1 in the St. Clair County Circuit Court against Samuel Douglas and Susan Douglas alleging negligence.

According to the complaint, the plaintiffs allege that on April 12, they were lawfully upon defendants' rental property in O'Fallon to attend a family gathering following the death of their father when the deck suddenly collapsed, causing injuries.

The plaintiffs hold Samuel Douglas and Susan Douglas responsible because they allegedly failed to inspect the deck to determine whether or not it was safe, and failed to adequately secure or support the deck to bear weight.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount of more than $50,000, plus costs of court.
