Man sues homeowners over trip, fall

EDWARDSVILLE — A Madison County resident is suing two homeowners after he allegedly fell in their backyard on the Fourth of July. 

Ryan J. Shelton filed a complaint on June 6 in the Madison County Circuit Court against Frederick Fucinari and Spring Funinari, alleging negligence. 

According to the complaint, the plaintiff alleges he was lawfully on the defendants' property on July 4, 2016, when he allegedly tripped and fell on an uneven surface in their backyard. 

Shelton claims he sustained injuries that caused him to suffer pain, disability and disfigurement and incur medical expenses. 

The plaintiff alleges the defendants failed to make sure that their backyard was safe for guests.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds of $50,000, plus the costs of this suit. 

He is represented by Albert S. Watkins and Michael D. Schwade of Kodner Watkins LC in St. Louis.
