United Thermal Industries allegedly failed to pay contributions

BENTON — Employee benefit fund administrators are suing United Thermal Industries for allegedly failing to make contributions to employee benefit funds.

Central Laborers’ Pension Fund, Central Laborers’ Welfare Fund, Central Laborers’ Annuity Fund and Russell Davenport filed a complaint on May 29 in the U.S. District Court for the Southern District of Illinois against United Thermal Industries Inc., alleging it violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant failed to comply with the terms of an agreement by allegedly failing pay all of its contributions from Jan. 1, 2017 to Feb. 28, 2018.

As a result of defendant's alleged actions, the plaintiffs' employee welfare benefit funds have suffered $1,886.15. in damages, the suit states.

The plaintiffs request a trial by jury and seek judgment against the defendant in the amount of $1,886.15 for unpaid contributions and liquidated damages, plus interest, attorneys’ fees, costs and any other relief that is appropriate.
