Dana Companies, others accused of negligently exposing man to asbestos fibers

EDWARDSVILLE — Two individual are suing Dana Companies, Genuine Parts Co., Maremont Corp. and several other companies for alleged negligence.

Harold W. Dugan and Juanita Dugan filed a complaint on May 25 in the Madison County Circuit Court, alleging that the defendants failed to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiffs allege that Harold Dugan was exposed to and inhaled or ingested asbestos fibers emanating from products that the defendants allegedly manufactured, sold, distributed or installed. On Jan. 3, he allegedly was diagnosed with asbestosis, an asbestos-induced disease, the suit states.

The plaintiffs hold the defendants responsible for allegedly including asbestos fibers in their products when adequate substitutes allegedly were available and for allegedly failing to adequately warn Harold Dugan about the dangers of working around products that contain asbestos fibers.

The plaintiffs request a trial by jury and seek no less than $50,000 in compensatory damages, plus any further relief that the court may deem appropriate. They are represented by Peter D'Angelo and Elizabeth V. Heller of Goldenberg Heller & Antognoli PC in Edwardsville.
