Motorist sues over Christmas Eve crash

EDWARDSVILLE — A motorist is suing a driver for allegedly causing a Christmas Eve collision. 

James R. Hernandez filed a complaint on May 11 in the Madison County Circuit Court against Lynne Burnett, alleging she failed to maintain proper control of the vehicle she was driving.

According to the complaint, the plaintiff alleges that on Dec. 24, 2016, he was driving his vehicle westbound on West Delmar near its intersection with Homer Adams Parkway when Burnett struck his vehicle from the rear. 

He claims he sustained injuries to his neck that caused him to experience pain and suffering, lost wages, the inability to work and incurred medical expenses. 

The plaintiff alleges Burnett negligently drove at a speed greater the was reasonable, failed to keep her eyes on the road and failed to stop at a traffic control device.

The plaintiff requests a trial by jury and seeks damages of not less than $50,000, plus costs of this action.
