Asbestos lawsuit filed against Carboline, URS, others

BELLEVILLE — A man alleges he developed lung cancer because of exposure to asbestos.

James L. McDaniel filed a complaint May 4 in the St. Clair County Circuit Court against Carboline Co., Evenheat Kiln Inc., URS Corp. and others alleging the asbestos products manufacturers failed to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges that on Dec. 7, 2017, he found out he developed lung cancer. He alleges it is an asbestos-induced disease that was wrongfully caused by exposure to asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. He claims has suffered great pain and anguish and became liable for medical care and treatment expenses. The plaintiff holds the defendants responsible because they allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory and punitive damages of more than $50,000 and further relief the court deems appropriate. He is represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
