Swansea nursing home, hospice care allegedly failed to prevent patient's fall

Medical malpractice 07

BELLEVILLE — A daughter is suing a nursing facility operator, claiming insufficient measures were taken to prevent her mother's injuries.

Tanashiska Lumas, as independent administrator of the estate of Greta Nunn, deceased, filed a complaint April 20 in the St. Clair County Circuit Court against Swansea Rehabilitation & Health Care Center alleging violation of the Nursing Home Care Act.

Vitas Healthcare Corp. of Illinois was listed as a respondent in discovery.

According to the complaint, Nunn was a resident at Swansea Rehabilitation & Health Care Center when she was taken to the emergency room on April 30, 2016. She was diagnosed as having received a double dose of morphine. Nunn was discharged the next day and referred to Vitas Healthcare for hospice care. She returned to the emergency room May 5, 2016, after falling. She underwent surgery due to a hip fracture.

The plaintiff alleges Swansea Rehabilitation and Vitas Healthcare failed to prevent Nunn from suffering avoidable falls, failed to implement safety precautions and failed to administer medications in accordance with the physician's orders.

The plaintiff seeks judgment against Swansea Rehabilitation for more than $50,000 as well as attorney fees and costs of court.

She is represented by Daniel C. Katzman of Katzman & Sugden LLC in Belleville.
