American Family Insurance accused of not settling underinsured motorist claim

EDWARDSVILLE — A driver and passenger claim an insurance company failed to approve an underinsured-motorist claim after they were injured in a car crash.

Steven D. Meyer and Crystal Meyers filed a complaint April 9 in the Madison County Circuit Court against American Family Insurance, alleging it failed to perform its contractual obligations.

According to the complaint, the plaintiffs allege that on Sept. 24, 2016, they were injured when they were involved in a collision with Bobby Elliott, an underinsured driver. At the time of the accident, they claim they were covered under the liability policy issued by the defendant, for which they are making an underinsured-motorist claim. 

The plaintiffs alleges American Family Insurance failed to settle the plaintiffs' claim for damages.

The plaintiffs request a trial by jury and seek judgment against the defendant in a reasonable amount exceeding $50,000, plus costs of court.
