BELLEVILLE — A motorist is suing another driver for allegedly running a stop sign and causing a collision on North Illinois Street.
Phyllis Nester filed a complaint on March 23 in the St. Clair County Circuit Court against Michelle Kimbrough-Cason, alleging she breached her duty to exercise reasonable care while driving an automobile.
According to the complaint, the plaintiff alleges that on March 30, 2016, he was traveling north on North Illinois Street near its intersection with Frank Scott Parkway when the defendant, who was coming from the opposite direction, suddenly made a left hand turn in front of plaintiff's vehicle. As a result, the plaintiff was caused to strike the defendant's vehicle.
Nester claims he suffered injuries to his neck, shoulder and low back.
The plaintiff alleges Kimbrough-Cason failed to yield right of way, failed to keep proper lookout and failed stop at the stop sign to avoid the collision.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000 and all other relief that are proper and just.
